Worried the ATO might come knocking? If you’re running a fast-growing business, it’s a valid concern. Complex rules, mounting obligations, and tight cash flow can turn an honest mistake into an audit trigger.

At Quantum House, we’ve been helping Australian business owners in various industries, including e-commerce, childcare, hospitality, professional services, and more since 2010.

This article shows early warning signs of an ATO audit and clear steps you can take to reduce your audit risk today.

ATO audit rates are rising — and so is scrutiny

The Australian Taxation Office conducts thousands of reviews and audits every year. Their focus? High-risk behaviours, incorrect reporting, and businesses that don’t look right on paper.

Whether you’re making legitimate R&D claims or trying to stay on top of BAS, your business could be at risk — especially if your accountant is more reactive than strategic.

Sign 1: Your tax position doesn’t match industry averages

The ATO uses sophisticated data-matching tools to compare your business against others in your sector. If your margins, expenses, or declared income are significantly out of step, it can raise a red flag.

Example: If a hospitality business shows low sales but high wage costs, the ATO may check for under-reported income.

Sign 2: Late BAS, PAYG, or super payments

Late or missing lodgements attract audits. Repeated delays in reporting your business activity statement (BAS), superannuation, or PAYG payroll suggest disorganisation or non-compliance with the ATO.

Missing deadlines is risky. Many business owners postpone lodgements when cash flow is tight, hoping to “catch up later.” But unless your finances improve, you’ll likely keep falling further behind.

Sign 3: Aggressive deductions or R&D claims

Large deductions — especially if they’re out of proportion to your income — will stand out. The same goes for claiming the R&D Tax Incentive without clear supporting records.

The ATO and AusIndustry have increased their focus on R&D compliance, targeting ineligible claims and vague activity descriptions. The ATO also reserves the right to amend or review R&D claims up to four years after lodgment. Non-compliant applications may be referred back to AusIndustry for further scrutiny.

Sign 4: Related-party transactions that lack transparency

Do you pay rent to a related entity? Transfer IP between companies? Hire contractors who are family members?

The ATO monitors related-party dealings that could artificially shift profits or reduce tax liabilities without a commercial justification. If they sense anything unusual, you’re more likely to be audited.

Sign 5: You’ve received ATO letters or queries

Not all audits start with a full-blown investigation. Often, the ATO will send a letter, make a phone call, or ask for clarification on a specific item.

This is your early warning. If you ignore it — or your accountant fumbles the response — issues can escalate quickly.

How to avoid an ATO audit

Staying off the ATO’s radar is about preparation, not perfection. Audit risk increases when records are disorganised, tax positions fail to meet expectations, or your accountant overlooks important details.

Here’s how to reduce that risk:

  • Maintain accurate and up-to-date records, including supporting documentation for deductions, payroll, and transactions with related entities.
  • Lodge everything on time — from BAS and PAYG to superannuation and tax returns.
  • Review your structure — some structures are more transparent and tax-efficient than others.
  • Avoid red flags — such as large one-off deductions, repeated losses, or inconsistent financial reporting.
  • Seek proactive advice — before making decisions that could impact the amount of tax you pay.

Most audit problems aren’t deliberate — they result from unclear advice, missed details, or poor communication with accountants. Regardless, once the ATO investigates, addressing issues becomes more stressful and costly.

If you’re unsure whether your current setup would hold up under ATO scrutiny, now is the time to evaluate your position.
